Photo & Portfolio License
This document is a working draft. A final, attorney-reviewed version will replace it before public launch.
The short version
You submit photos of your yard so we can design your plan. Those photos stay between us, used only for your project, unless you explicitly give us permission to feature them in our marketing or portfolio.
What you grant — design use (required)
When you submit photos as part of your intake, you grant GardenBedStudio a non-exclusive, limited license to use those photos for the sole purpose of designing and delivering your plan. This license is necessary for us to do the work.
What you may grant — portfolio and marketing use (opt-in)
If, and only if, you affirmatively consent in writing, you may grant us a broader license to:
- Feature your before and after photos (and finished-project photos, if applicable) in our marketing materials, blog posts, Pinterest, Instagram, portfolio page, case studies, and other public-facing channels.
- Identify you by first name and city only (e.g., “Meg, Indianapolis”), unless you prefer full anonymity.
- Edit, crop, resize, and combine the photos for visual presentation, while preserving accuracy.
This broader license is opt-in. We do not assume it. We do not require it as a condition of using the Service.
Your rights
- Opt-out any time. Even after granting portfolio permission, you can email us and we will remove your photos from our marketing within 14 days.
- Request deletion. Email us and we will delete your photos from our servers, subject to records retention obligations.
- Review before publishing. If you’re uncomfortable with a specific intended use, tell us and we’ll route around it.
What we commit to
- We will never publish photos of minors.
- We will not include house addresses, visible vehicle plates, or other identifying details in public marketing.
- We will not misrepresent a design. Before/after photos will always accurately reflect what GardenBedStudio delivered and what was actually planted.
- We will never sell or sublicense your photos to third parties for their marketing.
How you grant portfolio consent
We ask at the close of your project, through a dedicated consent form. Your signature (digital acknowledgment) documents the grant. You retain a copy for your records.
